EAGLE SHARK welcomes a future legal framework for private security companies

EAGLE SHARK recognizes the need for common EU rules and we are looking forward to the words of Federica Mogherini, Vice-President of the Commission, being realized: “It is now essential that we continue to work for this framework to be expanded…So it is essential that our institutions continue to engage regularly with the International Code of Conduct Association in order to meet common standards. A stronger legal framework for private security companies is in everybody’s interest: it is certainly in the European Union’s interest, so that they can contribute in the right manner to the security of many people, from diplomatic staff to humanitarian workers, around the world.” From the plenary debate 3 July 2017.
However, at this early stage EAGLE SHARK has a few introductory remarks. Although the resolution text is positive in general the fact remains that a wrong image of the private security industry is very often drawn and thus
EAGLE SHARK sees a real risk of overregulation. We urge the different actors to seek as much information on private security companies as possible and to take a close look on existing legislation that can be used for a similar purpose. In particular we draw the attention to the EU public procurement rules and common contract law that are fully suitable when outsourcing public tasks as well as the EU data protection rules and national criminal codes.
EAGLE SHARK will welcome the green paper and the following consultation all of which we hope to see in a short period of time.
